The Competition Council is concerned that public administrative bodies encourage fair competition. Public Administrative Bodies Supervision Division helps to achieve this goal by analysing the likely competitive effects of draft legal acts and decisions adopted by public administrative bodies, as well as by paying attention to the creation of a more favourable competition environment.

1 Part 1 of Article 4 of the Law on Competition states that in carrying out the assigned tasks related to the regulation of economic activities within the Republic of Lithuania, public administrative bodies must ensure the freedom of fair competition.

2 Part 2 of Article 4 of the Law on Competition stipulates that public administrative bodies are prohibited from adopting legal acts or other decisions which grant privileges or discriminate against any individual undertakings or their groups, and which give or may give rise to the differences in the conditions of competition for undertakings competing in a relevant market, except where the differences in the conditions of competition may not be avoided when meeting the requirements of the laws of the Republic of Lithuania.

In accordance with these provisions, in order to find out whether undertakings competing in the same market are not subject to different competition conditions, Public Administrative Bodies Supervision Division examines the compliance of legal acts, agreements concluded with undertakings and other decisions adopted by public administrative bodies with Article 4 of the Law on Competition.

In addition, the Competition Council examines draft laws and other draft legal acts and submits the conclusions on their competitive effects to the Seimas and the Government of the Republic of Lithuania. The Competition Council examines draft legal acts on its own initiative or after receiving them from other institutions.
