ANTI-COMPETITIVE AGREEMENT IN MUNICIPAL WASTE COLLECTION AND TRANSPORTATION SECTOR

On December 8, 2016 the Competition Council found that in 2015 UAB Ekoaplinka, UAB Ecoservice and UAB Marijampolės švara (hereinafter – Companies) concluded a collusive bidding agreement while participating in the public procurement for the purchase of municipal waste collection and transportation services, which was organised by UAB Marijampolės apskrities atliekų tvarkymo centras (hereinafter – UAB MAATC). Such restriction of competition might have resulted in higher prices of municipal waste collection and transportation services for consumers.

On December 11, 2015, having suspected that the Companies concluded a collusive bidding agreement in the public procurement organised by UAB MAATC, the Competition Council opened the investigation on its own initiative.

The Competition Council’s experts found that a representative of UAB Ecoservice, acting upon the knowledge of UAB Marijampolės švara, prepared the project of a bid for UAB Ekoaplinka, including the price and data for its calculation, according to which UAB Ekoaplinka submitted the bid to UAB MAATC. No modifications to the bid price or its calculation were introduced by UAB Ekoaplinka, except for a few minor changes to the project. Besides, UAB Marijampolės švara and UAB Ecoservice consulted UAB Ekoaplinka prior to the submission of the bid, as well as after bid opening.

By concluding a collusive bidding agreement, the Companies achieved the result which was favorable only to them. This proves without a shadow of a doubt that the Companies did not act independently, but coordinated their behavior and in this way restricted competition

For the anti-competitive agreement, the Competition Council fined UAB Ekoaplinka EUR 4,100, UAB Ecoservice EUR 601,700 and UAB Marijampolės švara – EUR 48,500.
