COMPETITION COUNCIL CLOSED INVESTIGATION INTO THE ACTIONS OF ŠALČININKAI MUNICIPALITY

On 25 September, the Competition Council (KT) sent a Statement of Objections to Šalčininkai municipality (Municipality) suspected of antitrust violation. According to the preliminary evaluation carried out by the KT‘s experts, municipal council‘s decision authorising UAB Tvarkyba and UAB Eišiškių komunalinis ūkis to arrange waste management system breached Article 4 of the Law on Competition.

The KT‘s preliminary established that the Municipality concluded agreements with the aforementioned companies without a competitive procedure and, thus, discriminated against other companies that operate within the market of waste management. The Statement of Objections suggested the Municipality to repeal the aforementioned municipal decision and, thus, eliminate the breach.

Having received the Statement of Objections, a suspected undertaking or public administrative body is given an opportunity to familiarize with the material of an investigation and provide a written explanation. Explanations can also be provided orally at the open hearing. The KT takes into consideration all the explanations before making the final decision.
