COMPETITION COUNCIL OPENS INVESTIGATION ON ALLEGEDLY MISLEADING ADVERTISING OF TIRES

Competition Council (the Council) opened an investigation on allegedly misleading advertising related to the prices of tyres provided by the store chain Vianor.

Having noticed the advertisements of tyre prices promoted on the website www.delfi.lt, the Council opened an investigation. The advertisements stated: ‘The leader of the lowest prices in Lithuania! Vianor‘ and ‘Tires at the lowest prices in Lithuania’.

The preliminary analysis showed that other companies offered to purchase tires at lower prices than indicated in the advertisement of tires sold by Vianor.

With regard to the aforementioned circumstances and pursuant to the Law on Advertising, the Council will evaluate whether the advertisement concerned may be misleading.

Opening of investigation by the Council means that there are reasonable grounds to suspect an infringement, however it does not mean that such an infringement exists.

(1) Misleading advertising means advertising which in any way, including its presentation, misleads or is likely to mislead the persons to whom it is addressed or whom it reaches and which, by reason of its misleading nature, is likely to affect their economic behaviour or which, for those reasons, harms or is likely to harm another person’s capabilities to compete (Law on Advertising, Article 2(3)).
