COMPETITION COUNCIL WILL NOT INVESTIGATE ALLEGEDLY MISLEADING ADVERTISING BY TELE 2
On April 1, the Competition Council (the KT) decided not to investigate allegedly misleading advertising by UAB Tele2.
On February 19, the KT received a complaint from UAB EUROCOM and UAB Bitė Lietuva (the Complainants) about the allegedly misleading advertising by UAB Tele2. According to the Complainants, the advertisement breached the criteria of the permitted comparative advertising set out in Article 6 of the Law on Advertising and, thus, could have mislead consumers.
Having analysed all the information and arguments provided by the interested parties and pursuant to Article 25(7) of the Law on Advertising, the KT decided not to open the investigation. According to the KT, in this case, even if the interests of the undertakings engaged in commercial practices were undermined, it does not mean that the rights and interests of consumers were jeopardized. Moreover, the Complainants did not prove how the advertisement could have affected the economic behaviour of consumers and, thus, violated their rights and interests.
