“PRAM AR“ FINED FOR MISLEADING ADVERTISING

The Competition Council having in its meeting examined the findings of the completed investigation passed a resolution to acknowledge the advertising published by UAB Pram Ar misleading. The Competition Council imposed a fine in the amount of LTL 2,000 for the infringement of the Law on Advertising publishing the advertising statements about performers who will be the participants of the program Žvaigždės ant ledo ("Stars on Ice“).

The Competition Council initiated the investigation concerning the alleged infringement of the Law on Advertising on the basis of the complaint of a consumer who claimed that the advertising of the event Žvaigždės ant ledo published on different occasions indicated different performers, although none of the advertisements provided a correct list of participants of the event. Having attended the event the consumer claimed she did not see some of the performances indicated in the advertisements.

The investigation conducted revealed that the advertising published in the weekly Ekspress nedelia and the internet website www.bilietai.lt on the event Žvaigždės ant ledo that took place on 14 April 2007 in Vilnius was inaccurate. The advertising statements misled the consumers and influenced the economic behaviour of the consumers, i.e., their decisions or actions related to the acquisition of the tickets to the event Žvaigždės ant ledo.

Having established the infringement of the requirements of the Law on Advertising and by imposing a fine to the company Pram Ar the Competition Council took into account the fact that the company at its own initiative refunded to the consumer the price of the ticket to the event.
