RAUTAKIRJA OY INVESTIGATION LAUNCHED

The meeting of the Competition Council examined the application filed by UAB Medipresa and resolved to launch the investigation concerning actions of Rautakirja Oy allegedly infringing the terms and obligations that the Competition Council had imposed upon Rautakirja Oy on 27 October 2005. The Competition Council had authorised the implementation of the concentration deal by Rautakirja Oy through the acquisition of the 100 percent holding of the Vilnius agency of UAB Lietuvos spauda subject to certain conditions and obligations necessary to ensure the avoidance of creation of a dominant position or a significant restriction of competition in the relevant market. The evidence produced by UAB Medipresa, the joined report furnished with the Competition Council by Rautakirja Oy, the Vilnius agency of UAB Lietuvos spauda and  UAB Impress Teva concerning the adherence to and the fulfilment of obligations undertaken by Rautakirja Oy as well as the supplementary information submitted during the meeting constituted the grounds for the suspicion that Rautakirja Oy could have possibly infringed the terms and obligations provided for in the relevant Resolution of the Competition Council.

Upon resolving to institute an investigation concerning the compliance of actions of Rautakirja Oy with the conditions and obligations for the performance of the concentration as stipulated in the Resolution of 27 October 2005 of the Competition Council and the requirements of Article 9 of the Law on Competition the Competition Council resolved to impose the interim measures for a duration of two months. The measures thus applied are designed to maintain the current competition situation and to prevent substantial damage or irreparable consequences for the interests of undertakings.
