SENUKŲ PREKYBOS CENTRAS FINED FOR MISLEADING ADVERTISING

Having assessed the findings of the completed investigation the Competition Council recognized the advertising statement used by UAB Senukų prekybos centras to constitute misleading advertising. The statement concerned the technical characteristics of ARDO FLZ 105 S washing machine and was uploaded in the company‘s Internet website at www.senukai.lt declaring “Silence” system – soundless operation”. For the use of the misleading advertising statement the company was subjected to a fine of LTL 3,000.

The Competition Council was applied to by a consumer allegedly mislead by the announcement of the technical characteristics and other advantages of the ARDO FLZ 105 S washing machine to the effect that the machine had an integrated “Silence” – soundless operation system. The investigation established that the model of the washing machine of the type did not have the advertised noise-suppressing facility “Silence”. The consumer was mislead by the statement in question and induced to acquire the washing machine of the exactly the model. A user independently is not in a position to check whether the “Silence” system is installed in the washing machine which can be performed by a qualified specialist only.
