THE COMPETITION COUNCIL INITIATED AN INVESTIGATION CONCERNING HE ACTIONS BY MAXIMA LT UAB

In its meeting the Competition Council resolved to initiate an investigation concerning the compliance of actions by MAXIMA LT UAB with the requirements of the Law on Competition related to the implementation of control over concentration.

On 19 May 2008, the Competition Council was submitted the notification on an intended concentration deal of MAXIMA LT UAB by leasing or acquiring premises of commercial purpose located in different towns and cities of Lithuania.

The investigation was prompted by a suspicion that the gross annual income of the undertakings - participants in the concentration transaction of 2002 - 2006 exceed the threshold established in the Law on Competition therefore the concentration had to be notified to the Competition Council and an appropriate authorisation from the Competition Council had to be obtained. The notification had to be filed before the implementation of the concentration deal. Since MAXIMA LT UAB did not apply to the Competition Council concerning the intended concentration, actions of the Company when acquiring or leasing the premises of commercial purpose constitute a basis for a suspected infringement of the Law on Competition.
