UAB „ENIRO LIETUVA“ FINED FOR MISLEADING ADVERTISING ABOUT THE CATALOGUE

The Competition Council, having in its meeting examined the findings of the investigation and heard the explanations of the interested parties passed the decision concerning the statements used in the advertising by UAB „Eniro Lietuva“ about the advantages of the catalogue „Visa Lietuva” („The entire Lithuania“) published by the company. Having recognised some of the statements used as misleading advertising the Competition Council obligated the company to forthwith cease the use of the misleading advertising, UAB „Eniro Lietuva“ was subject to a fine of LTL 1,000 for the infringement of Art. 5 of the Law on Advertising.

The Statements that were recognised by the Competition Council as misleading included such as „The circulation of the catalogue - 100,000 copies“ „Circulation of the catalogue and the compact disc - 100,000 copies:, each working day site www.visalietuva.lt <http://www.visalietuva.lt> is visited by over 4,000 visitors“ www.visalietuva.lt <http://www.visalietuva.lt> is the most frequently visited business information site on the internet, „the only construction and related activities information catalogue distributed at no charge“, and other similar statements. The Competition Council concluded that for the purpose of promoting the published catalogue UAB „Eniro Lietuva“ had used some misleading statements which could have mislead the advertising consumers and had an impact upon their economic behaviour.

The investigation concerning the advertising texts used by UAB „Eniro Lietuva“ was initiated against a complaint received form UAB „Saulės spektras“ competing with the company under investigation. In the year 2004 in view of the misleading and prohibited comparative advertising in the catalogue „Mūsų Lietuva 2004“ the Competition Council had fined UAB „Saulės spektras“. Then the investigation was initiated against a complaint of UAB „Eniro Lietuva“.
