On July 18 the President of the Republic of Lithuania Dalia Grybauskaitė appointed Elonas Šatas as Council Member of the Competition Council for the second six-year term starting on 24 August 2017.

COMPETITION COUNCIL FINED AB KAUNO GRŪDAI FOR UNNOTIFIED MERGER

The Competition Council found that having acquired about 51 per cent of Vievio paukštynas shares and gained control over the company, Kauno grūdai implemented unnotified merger. For the infringement of the Law on Competition, the Council fined Kauno grūdai EUR 947,700.

UAB KONCERNAS ACHEMOS GRUPĖ SUSPECTED OF HAVING IMPLEMENTED UNNOTIFIED MERGER

The Council completed an investigation into suspected unnotified merger by koncernas Achemos grupė . According to the Council‘s preliminary findings, in 2013 koncernas Achemos grupė acquired sole control of UAB Jūros vartai and AB Klaipėdos laivų remontas and by doing so implemented unnotified merger.

FINAL DECISION OF SUPREME ADMINISTRATIVE COURT IN LUKOIL BALTIJA CASE

The Supreme Administrative Court of Lithuania (hereinafter – Court) upheld the Lithuanian Competition Council’s decision of December 12, 2014 whereby UAB AMIC Lietuva (former UAB Lukoil Baltija ) received a fine of EUR 3 297 700.

COMPETITION COUNCIL: MERGER BETWEEN CLASSIFIED ADS WEBSITES RESTRICTED COMPETITION

On 6 May 2016, the Competition Council (hereinafter – KT) prohibited a merger whereby in 2014  AS Eesti Meedia  acquired 100 per cent of  AllePAL OÜ  shares. KT found that the merger restricted competition in the Lithuanian markets of classified ads for real estate and vehicles.

NEW MERGER NOTIFICATION AND EXAMINATION PROCEDURE CAME INTO FORCE IN LITHUANIA

Lithuanian Competition Council (the Council) announced that the new Merger Notification and Examination Procedure (the Merger Procedure) had come into force on 1 January 2016. As of that date, all merger notifications must be submitted in line with the new Merger Procedure.

SUPREME COURT UPHELD COMPETITION COUNCIL‘S DECISION TO SANCTION LUKOIL BALTIJA FOR NON-NOTIFIED MERGERS

The Supreme Administrative Court of Lithuania (the Court) upheld the Competition Council‘s (KT) decision as of April 18, 2013 to impose a fine of 341 057 EUR on JSC  Lukoil Baltija  for implementing non-notified mergers.
